FLAARE Terms of Service

Last updated: 16 October 2026

This English version is provided for information purposes only. The legally binding version of these Terms is the Polish version. In the event of any discrepancy, the Polish version prevails.

§ 1. General provisions and definitions

  1. These Terms of Service (“Terms”) set out the rules for using the website available at flaare.pl and the FLAARE application - a drone operations management system - as well as the rights and obligations of the Service Provider, Customers and Users.
  2. The service provider is Mikołaj Wachulski, conducting business under the name UAV Service Mikołaj Wachulski, Ojrzanowo 29, 89-210 Ojrzanowo, Poland, tax ID (NIP) 5621805694 (the “Service Provider”). Contact: kontakt@flaare.pl, phone +48 500 072 567.
  3. Capitalised terms used in these Terms mean:
    • Website - the website available at flaare.pl together with its subpages;
    • Application - the FLAARE software provided as a service (SaaS) in a web browser, together with related services (including reception of telemetry from DJI controllers);
    • Customer (Unit) - the entity for whose benefit access to the Application is provided, in particular a fire-protection unit, search-and-rescue group, public body or business;
    • User - a natural person using the Application under an account assigned to a Customer (in the operator or pilot role), or a person using the Website;
    • Distributor - uStrażaka.pl Sp. z o.o., the entity operating the uStrażaka.pl service, being the exclusive distributor of the “FLAARE for services” edition;
    • Video Provider - the entity operating the server that receives the video stream from the drone and provides the player embedded in the Application; in the “FLAARE for services” edition this is the Distributor (uStrażaka.pl Sp. z o.o.), and in the “FLAARE Enterprise” edition - the Service Provider;
    • Licence - the Customer’s paid right to use the Application for the period and on the conditions resulting from the order placed with the Distributor and from these Terms;
    • KOL Module - the Air Operations Coordinator module enabling cross-organisation coordination of operations in airspace;
    • Consumer - a natural person performing a legal transaction not directly related to their business or professional activity, and any natural person to whom consumer-protection provisions apply under separate statutes.
  4. These Terms constitute terms of provision of services by electronic means within the meaning of Article 8 of the Polish Act of 18 July 2002 on the provision of services by electronic means. The Terms are made available free of charge on the Website in a form that allows them to be downloaded, stored and printed.
  5. The Application is addressed primarily to professional entities (units, services and businesses). Provisions concerning Consumers apply only where the User or Customer is a Consumer.

§ 2. Type and scope of services

  1. FLAARE is an IT tool for the coordination and management of unmanned aircraft system (UAS) operations. Within the Application the Service Provider makes available, in particular:
    • an automatic flight log created from DJI device log files, with export capability;
    • an operations map presenting drone positions and telemetry in near real time;
    • live video streaming from the drone camera, embedded in the Application on the terms set out in § 8a;
    • a mission planner enabling the preparation of proposed routes and their transfer to DJI controllers;
    • a register of the unit’s resources (fleet, batteries, checklists, personnel together with qualification expiry dates) and an incident register;
    • the KOL Module.
  2. The Application is not used to control aircraft and is not an air traffic management system or any part of one.
  3. The scope of functionality available to a Customer results from the purchased edition and Licence. The Service Provider may develop, change and introduce new editions of the Application (including the “FLAARE Enterprise” edition); changes extending functionality do not constitute an amendment of the Terms. The Service Provider may limit or withdraw functionality dependent on external services in the cases referred to in § 7(3a).
  4. Using the Application requires: Internet access, a current version of a popular web browser with JavaScript enabled and - for telemetry features - compatible DJI hardware running a software version supported by the Application, paired with the Application. The Customer is responsible for meeting the technical requirements on its side.
  5. Users are prohibited from providing unlawful content.

§ 3. Conclusion of the agreement and the Licence

  1. Sales of Licences for the “FLAARE for services” edition are conducted exclusively by the Distributor (uStrażaka.pl), on commercial terms set by the Distributor (including pricing, invoicing and terms of sale). The agreement for the provision of access to the Application on the terms of these Terms is concluded between the Customer and the Service Provider upon activation of the Licence.
  2. The Customer accepts the Terms at the latest when placing the order with the Distributor, and each User confirms having read and accepted the Terms on first login to the Application. Use of the Application constitutes acceptance of the Terms.
  3. Unless the order provides otherwise, a Licence covers one organisational unit of the Customer, support for up to 5 drones and up to 25 User accounts; these limits may be extended for an additional fee.
  4. The Licence is non-exclusive, non-transferable and entitles the Customer to use the Application solely for the purposes of its own activity.
  5. After the Licence period expires, access to the Application may be limited to read-only and data-export mode for a transitional period of 30 days, after which the account may be deactivated and the data deleted in accordance with § 11.

§ 4. Accounts and Users

  1. User accounts within the Customer’s organisation are created and managed by a designated User with the operator role. Self-registration of accounts is not possible.
  2. The User is obliged to keep login credentials confidential, not to share the account with third parties, and to notify the Service Provider immediately of any suspected unauthorised access to the account.
  3. The Customer is liable for the acts and omissions of Users using the Application within its organisation as for its own acts, and undertakes to make its personnel familiar with these Terms.
  4. The Service Provider may suspend a User’s or Customer’s account in the event of a material breach of the Terms, or use of the Application in a manner endangering its security or the security of other Customers’ data, after first calling for the breach to cease, unless the nature of the breach requires an immediate response.

§ 5. User obligations

  1. The User is obliged to use the Application in accordance with the law, including in particular:
    • Commission Implementing Regulations (EU) 2019/947 and 2019/945 and other provisions concerning unmanned aircraft systems;
    • Polish aviation law and the rules for the use of airspace, including the requirements of the Polish Air Navigation Services Agency (PANSA) and the PansaUTM system;
    • the operational conditions applicable to the operator (including standard scenarios, authorisations and geographical-zone restrictions).
  2. The User is obliged to enter true, complete and up-to-date data into the Application. The Service Provider does not verify the substantive correctness of data entered by Users (including data on personnel qualifications, equipment condition or flights) and is not liable for the consequences of such data being untrue or out of date.
  3. It is prohibited in particular to: attempt unauthorised access to other organisations’ data, interfere with the operation of the Application, use the Application for unlawful purposes, or resell or make access to the Application available to third parties without the Service Provider’s consent.

§ 6. Responsibility for flight operations

  1. FLAARE is solely an auxiliary coordination and management tool. The Application does not perform flight operations, does not supervise them and does not ensure their safety.
  2. Sole responsibility for the preparation, execution and safety of every flight operation - including search-and-rescue actions, emergency-services activities and inspections - rests with the Customer, the UAS operator and the pilot performing the flight, in accordance with applicable aviation law.
  3. A mission plan generated in the Application (including the route, altitudes and terrain profile) constitutes solely a proposal requiring independent verification by the pilot and operator on every occasion before the flight begins - in particular with regard to terrain, obstacles, geographical zones and airspace structure, meteorological conditions, equipment condition and legal compliance. Terrain and map data used in the Application come from external sources and may be inaccurate, incomplete or out of date.
  4. Telemetry data presented in the Application (including drone positions on the operations map) may be delayed, incomplete or temporarily unavailable - it depends, among other things, on cellular connectivity and device operation. Such data must not be the sole basis for operational decisions and, in particular, does not serve to ensure separation between aircraft.
  5. The presentation of information on manned aircraft (AirSense/ADS-B) is indicative only and covers only aircraft equipped with transmitters and within reception range. The absence of an indication in the Application does not mean the absence of air traffic. The duty to observe the airspace and give way rests with the pilot.
  6. The KOL Module supports the exchange of information between organisations but does not constitute an air traffic service and does not replace legally required coordination with the competent authorities and services (including PANSA, ASAR and the officer in charge of a rescue operation). A coordinator using the KOL Module acts within their own competence and responsibility.
  7. The Service Provider is not liable for damage resulting from flight operations planned, coordinated or documented using the Application, including the consequences of operational decisions taken on the basis of data presented in the Application, nor for the outcome or effectiveness of search-and-rescue actions or inspections. This does not apply to damage caused by the Service Provider intentionally.

§ 7. Availability and liability of the Service Provider

  1. The Service Provider provides the service with due care but does not guarantee uninterrupted or error-free availability of the Application and does not provide any guaranteed availability level (SLA), unless otherwise agreed in a separate agreement with the Customer.
  2. The Service Provider reserves the right to technical interruptions related to maintenance, updates or development of the Application; the Service Provider gives advance notice of planned interruptions of material significance.
  3. The Service Provider is not liable for unavailability or malfunction of the Application resulting from: force majeure, failures of connectivity or infrastructure beyond the Service Provider’s control, acts or omissions of external providers (including cellular connectivity, map and terrain-data services, DJI services, services of a Video Provider other than the Service Provider), malfunction of the Customer’s equipment, or data entered by Users. 3a. The operation of part of the Application’s functionality (in particular reception of telemetry, video streaming from the drone, transfer of mission plans to controllers, and import and reading of log files) depends on programming interfaces, data formats, cloud services, software and licence terms made available by DJI or other hardware manufacturers, over which the Service Provider has no control. The manufacturer may change, limit or disable them at any time, including through a hardware software update. The Service Provider does not guarantee compatibility of the Application with future versions of the manufacturer’s hardware, software or services and is not liable for any limitation, degradation or loss of the Application’s functionality resulting from such changes. The Service Provider will make efforts to adapt the Application to such changes within a reasonable time, where technically and economically justified. Limitation or withdrawal of functionality for these reasons does not constitute non-performance or improper performance of the agreement and does not entitle the Customer to a reduction of the licence fee, unless mandatory provisions of law provide otherwise.
  4. The Service Provider’s total liability towards the Customer for non-performance or improper performance of the agreement is limited to the amount of the licence fee paid for the 12 months preceding the event giving rise to the damage, and liability for lost profits is excluded.
  5. The limitations and exclusions of liability provided for in the Terms do not apply: to damage caused intentionally, to the extent that mandatory provisions of law do not permit liability to be limited or excluded, or towards Consumers to the extent that such provisions would be deemed unlawful.

§ 8. KOL Module and data sharing between organisations

  1. Data sharing within the KOL Module requires the Customer to activate the relevant settings (at the level of the organisation and of individual drones).
  2. By enabling sharing, the Customer consents to the positions and basic data of its shared drones (organisation and drone identifier, position, heading, track and, during an ongoing video stream, also the drone camera video referred to in § 8a) being visible, during an active coordination session, to coordinators of other organisations within the session area, and to areas and points designated by the coordinator being displayed in its Application. The coordinator may only view the video and cannot control the stream; the coordinator’s access to the video ends when the coordination session ends.
  3. The Customer may disable sharing at any time. Visibility episodes are recorded in the Application.

§ 8a. Video streaming

  1. The Application enables live video from the camera of a drone paired with the Application to be started and displayed to the Users of the Customer’s organisation and, on the terms of § 8(2), also to the coordinator of another organisation during an active coordination session, provided that the coordinator’s organisation has video streaming enabled. The feature is available in the editions and to the extent resulting from the Licence (including the limit on the number of drones streaming simultaneously) and must be enabled for the Customer’s organisation by the Service Provider.
  2. The video is sent directly from the drone’s controller to the Video Provider’s server and displayed in the Application in the Video Provider’s embedded player; it does not pass through the Service Provider’s servers. The Video Provider is: in the “FLAARE for services” edition - the Distributor (uStrażaka.pl Sp. z o.o.); in the “FLAARE Enterprise” edition - the Service Provider.
  3. The stream is live only. The player address constitutes the credential for access to the video; the User may not share it with unauthorised persons. The Application does not record the video and does not allow it to be played back. In the “FLAARE Enterprise” edition the video is not recorded by the Video Provider either. In the “FLAARE for services” edition the rules of the stream, including its recording, storage and the sharing of recordings, are set out in the Distributor’s streaming service terms; the User is obliged to read them before starting a stream for the first time and to comply with them, and starting a stream constitutes acceptance of those terms.
  4. The Customer’s User decides when a stream starts and ends. The Customer is responsible for the lawfulness of capturing and transmitting the video, in particular for compliance with the provisions on the protection of personal data and image rights, privacy, and the protection of information and facilities, as well as for fulfilling information obligations towards persons captured in the video.
  5. The camera video is indicative only - it may be delayed, interrupted or unavailable, depending on cellular connectivity, DJI devices and the Video Provider’s services. It does not replace the visual observation required by law and must not be the sole basis for operational decisions. § 6(7) applies.
  6. To the extent that the video contains personal data: in the “FLAARE Enterprise” edition the Service Provider processes it on the Customer’s behalf under § 11; in the “FLAARE for services” edition the video and its recordings are processed by the Distributor on the terms set out in the Distributor’s streaming service terms, and the Service Provider has no access to the recordings.
  7. The Service Provider may suspend or disable video streaming for the Customer’s organisation in the event of Licence limits being exceeded, Licence expiry, a security threat or unavailability of the Video Provider’s services; § 7(3a) applies accordingly.

§ 9. Payments

  1. Fees for Licences for the “FLAARE for services” edition are collected by the Distributor according to its own price list and terms of sale available at uStrażaka.pl. The Service Provider does not conduct direct sales on the Website.
  2. Complaints concerning payments, invoices and the purchase process are handled by the Distributor; complaints concerning the operation of the Application - by the Service Provider (§ 10).
  3. The rules of sale of future editions of the Application (including “FLAARE Enterprise”) will be set out before they are made available - in these Terms or in separate terms, as appropriate.

§ 10. Complaints

  1. Complaints concerning the operation of the Website or the Application may be submitted to kontakt@flaare.pl or in writing to the Service Provider’s registered address.
  2. A complaint should identify the Customer/User, describe the problem and include contact details. The Service Provider responds within 14 days of receiving the complaint.
  3. A Consumer may use out-of-court complaint and redress procedures, including through the locally competent consumer ombudsman or the Voivodeship Inspectorate of Trade Inspection, as well as the EU online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr.
  4. Where the Customer is a Consumer, the digital content or digital service is subject to the provisions of the Polish Consumer Rights Act, including the provisions on conformity of the service with the contract; the Terms do not exclude any Consumer rights arising from mandatory provisions of law.

§ 11. Entrustment of personal-data processing

  1. To the extent that the Customer enters into the Application personal data of its personnel and other persons (including pilot data: name, contact details, licence numbers, qualification and examination expiry dates, assignment to flights and flight location data), the controller of such data is the Customer, and the Service Provider processes it on the Customer’s behalf as a processor within the meaning of Article 28 GDPR. Acceptance of the Terms is equivalent to concluding a data-processing agreement with the content set out in this section.
  2. Subject-matter and nature of processing: storage, organisation, making available to the Customer’s Users, and deletion of data within the functionality of the Application. Purpose: provision of the service of access to the Application. Duration: the term of the agreement and the transitional period referred to in § 3(5).
  3. Categories of data subjects: the Customer’s personnel and associates (in particular UAS pilots and operators), persons named in incident registers, persons captured in drone-camera video during a stream. Categories of data: identification and contact data, data on qualifications and licences together with expiry dates, data on flights performed (including location data), content entered in notes and registers, drone-camera video in a live stream.
  4. The Service Provider undertakes to: process the data only on the Customer’s documented instructions (which include use of the Application’s functionality), ensure that persons processing the data are authorised and bound by confidentiality, apply technical and organisational measures appropriate to the risk (Article 32 GDPR), support the Customer in fulfilling its obligations under Articles 32–36 GDPR and in responding to data subjects’ requests, and, upon termination of the agreement, delete or return the data as decided by the Customer, unless the law requires further storage.
  5. The Customer gives general consent to the Service Provider’s use of sub-processors for hosting, infrastructure maintenance, video streaming (§ 8a) and auxiliary services. The current list of sub-processor categories is set out in the Privacy Policy; the Service Provider informs the Customer of intended material changes, and the Customer may object within 14 days.
  6. The Service Provider enables the Customer to audit processing compliance by answering questions and providing the necessary documentation; an on-site audit requires the date to be agreed at least 14 days in advance and takes place at the Customer’s expense.
  7. The Service Provider notifies the Customer of any breach of the entrusted personal data without undue delay, and no later than 48 hours after establishing the breach.

§ 12. Intellectual property

  1. The Application, the Website and their elements (software, layout, graphics, logos, documentation) are the subject of rights of the Service Provider or its licensors and are protected by law.
  2. Data entered into the Application by the Customer, and the operational data of its organisation, remain the property of the Customer. The Customer may export them to the extent made available in the Application.
  3. Decompiling, reverse engineering, copying or making the Application available to third parties beyond the scope permitted by law is prohibited.

§ 13. Transfer of rights and obligations

  1. The Service Provider plans to continue the activity related to the Application within a capital company. The Service Provider may transfer all rights and obligations arising from agreements concluded under these Terms - including the role of processor and the role of controller of personal data to the extent described in the Privacy Policy - to a legal successor or an affiliated entity, in particular to a newly established limited-liability company (spółka z o.o.) that will take over the operation of the Application.
  2. The Service Provider notifies Customers of the transfer at least 14 days before it takes effect, identifying the successor. A Customer that does not accept the transfer may terminate the agreement with effect as of the transfer date; in that case the Distributor or the Service Provider refunds the fee proportionally to the unused Licence period.
  3. The transfer does not change the substance of the Customer’s rights under the Terms and does not require the Customer’s separate consent beyond the procedure described above.

§ 14. Amendments to the Terms and final provisions

  1. The Service Provider may amend the Terms for important reasons, in particular: changes in the law, changes in the scope or manner of providing services, security reasons, or organisational changes on the Service Provider’s side (including those described in § 13).
  2. The Service Provider informs Customers of an amendment to the Terms at least 14 days before it enters into force (on the Website, in the Application or by e-mail). A Customer that does not accept the amendments may terminate the agreement before they enter into force; continued use of the Application after that date constitutes acceptance of the amendments.
  3. The governing law is Polish law. Matters not regulated herein are governed by the Polish Civil Code, the Act on the provision of services by electronic means, the Consumer Rights Act and the GDPR.
  4. Disputes with Customers who are not Consumers are resolved by the court having jurisdiction over the Service Provider’s registered office. In disputes with Consumers, the competent court is determined by generally applicable law.
  5. These Terms were drawn up in Polish; the English version is for information only and, in the event of discrepancies, the Polish version prevails.
  6. The rules of personal-data processing are set out in the Privacy Policy.
  7. The Terms are effective as of 16 October 2026.
